In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Rhetoric 33.4 (2000) 319-335 [Access article in PDF] Rhetoric as a Technique and a Mode of Truth: Reflections on Chaïm Perelman Alan Gross In memoriam: Henry Johnstone, fons et origo.In one of his many criticisms of The New Rhetoric, the philosopher Henry W. Johnstone Jr. complains about its chapter "The Dissociation of Concepts" that "one is never sure whether [Chaïm Perelman is] thinking of rhetoric primarily as (...) a technique or primarily as a mode of truth. One wonders, too, what status [he is] claiming for the book itself" (1978, 99). 1 Since the chapter in question largely concerns philosophical argument, the doubt is very much apropos. But the response to Johnstone's implied question--a response that Johnstone does not think available--is that the correct answer legitimately varies in a systematic way. While in philosophical contexts, and, incidentally, in scientific ones, rhetoric is invariably a mode of truth, in contexts of public address it need not be. To see how this systematic variation might be the case, I will focus, as does Johnstone, on the dissociation of concepts as a test case of the robustness of a rhetoric oriented toward truth. To do so, I must first define dissociation and then come to terms with the way in which concepts are dissociated in public address, in philosophy, and in science. In treating these examples, however, I must be wary. While they will vary systematically according to field, they are not each instances of any general "law" of dissociation. Johnstone is surely right to "doubt whether there is any general logic of dissociation; there is only the logic of each particular dissociation, generated in each case by a particular problem" (99). When I have run through my examples, I can return to Johnstone's question about the status of rhetoric and of Perelman's study of it.Suppose that, in a campaign for the United States Senate, my opponent says that the central issue is high taxes, not the rise of medical costs, while I say that the central issue is medical costs, not high taxes. Neither of us [End Page 319] need be engaged in the dissociation of concepts; we may simply be excluding taxes and medical care, respectively, from political matters that deserve our immediate and full attention; we may simply be breaking the link between these issues and those of high political salience. In Perelman's words, "[T]he technique of breaking up a liaison consists... in asserting that elements that should remain separated and independent are improperly associated" (Perelman and Olbrechts-Tyteca 1969, 411). Yet, if we think that adequate medical care for all Americans is a moral issue, that it transcends politics, we are dissociating this issue from the category of campaign issues of the ordinary sort, those that deal "merely" with expediency. In the process, we are devaluing matters of mere expediency. Dissociation is a way of taking the argumentative high ground, of putting an issue on a different plane, an act that in this case turns a political race into a moral contest. In Perelman's words, "[T]he dissociation of notions brings about a more or less profound change in the conceptual data that are used as a basis of argument. It is then no more a question of breaking the links that join independent elements, but of modifying the very structure of these elements" (412).To illustrate this difference, I will use two parallel passages on the same topic: one from Stephen Douglas and the other from Abraham Lincoln, both from the debate between them in Alton, Illinois, on 15 October 1858. In his passage, Douglas stoutly defends states' rights: This government was made on the great basis of the sovereignty of the States--the right of each state to regulate its own domestic institutions to suit itself, and that right was conferred with the understanding and expectation that inasmuch as each locality had separate and distinct interests, each state must have different and distinct local and domestic institutions, corresponding to the wants... Tennenbaum's Theorem yields an elegant characterisation of the standard model of arithmetic. Several authors have recently claimed that this result has important philosophical consequences: in particular, it offers us a way of responding to model-theoretic worries about how we manage to grasp the standard model. We disagree. If there ever was such a problem about how we come to grasp the standard model, then Tennenbaum's Theorem does not help. In an attempt to provide some clarification in the abortion issue it has recently been proposed that since 'brain death' is used to define the end of life, 'brain life' would be a logical demarcation for life's beginning. This paper argues in support of this position, not on empirical grounds, but because of what it reflects of what is valuable about the term 'life'. It is pointed out that 'life' is an ambiguous concept as it is used in English, obscuring (...) the differences between being alive and having a life, a crucial distinction for bioethical questions. We present here solutions of a non-linear Schrödinger equation in presence of an arbitrary linear external potential. The non-linearity expresses a self-focusing interaction. These solutions are the product of the pilot wave with peaked solitons the velocity of which obeys the guidance equation derived by Louis de Broglie in 1926. The degree of validity of our approximations increases when the size of the soliton decreases and becomes negligible compared to the typical size over which the pilot wave varies. An important contribution to the foundations of probability theory, statistics and statistical physics has been made by E. T. Jaynes. The recent publication of his collected works provides an appropriate opportunity to attempt an assessment of this contribution.

Recent developments in biology have made it possible to acquire more and more precise information concerning our genetic makeup. Although the most far-reaching effects of these developments will probably be felt only after the Human Genome Project has been completed in a few years' time, scientists can even today identify a number of genetic disorders which may cause illness and disease in their carriers. The improved knowledge regarding the human genome will, it is predicted, in the near future make diagnoses (...) more accurate and treatments more effective, and thereby considerably reduce and prevent unnecessary suffering. On the other hand, however, the knowledge can also be, depending on the case, futile, distressing or plainly harmful. This is why we propose to answer in this paper the dual question: who should know about our genetic makeup and why? Through an analysis of prudential, moral and legal grounds for acquiring the information, we conclude that, at least on the levels of law and social policy, practically nobody is either duty-bound to receive or entitled to have that knowledge. Can there be a moral philosophy which combines Christianity and consequentialism? John Stuart Mill himself claimed that these positions were, at the least, not mutually exclusive, and quite possibly even congenial to one another; and some recent work by Christian philosophers in America has resurrected this claim. But there is a simple argument to show that consequentialism and orthodox Christianity are not so much as jointly assertible.

IT HAS OFTEN BEEN SUPPOSED that Aristotle's account of thought and action imposes severe limits on the functions and scope of practical reason; and insofar as Thomas Aquinas accepts Aristotle's account, he seems to be forced into the same restrictive view of practical reason. Practical reason expresses itself primarily in deliberation ; and the virtue that uses practical reason correctly is the deliberative virtue of prudence. Aristotle believes that deliberation is confined to means to ends, while will is focused on (...) ends. Some ends that are assumed on some occasions may on other occasions also count as means to more ultimate ends; but it seems that the most ultimate ends must be taken for granted in any deliberation. Since every deliberation must take for granted some end to which the deliberation finds means, the conclusions of rational deliberation must ultimately be about means to ultimate ends that are not themselves subject to practical reason. Paternalist policies in public health often aim to improve people’s well-being by reducing their options, regulating smoking offering a prime example. The well-being challenge is to show that people really are better off for having their options reduced. The distribution challenge is to show how the policies are justified since they produce losers as well as winners. If we start from these challenges, we can understand the importance of the empirical evidence that a very high proportion of smokers regret smoking. (...) In short, it is important that they regret it and important that the proportion is so high. This paper explains how, philosophically, regret can relate to well-being and it considers some of the strengths and weakness in the empirical research that the explanation brings out. The regret case for regulating smoking is indeed strong, although not as strong as the empirical researchers think. It is much weaker for paternalistic intervention in other public health problems, such as obesity and binge drinking. (shrink)

The best way to distinguish treatment from research is by their functions. This mode of distinction fits well with the basic ethical work that needs to be carried out. The distinction needs to serve as an ethical flag, highlighting areas in which the goals of doctors and patients are more likely than usual to diverge. The distinction also allows us to illuminate and understand some otherwise puzzling elements of debates on research ethics: it shows the peculiarity of exclusive conceptions of (...) the distinction between research and treatment; it allows us to frame questions about therapeutic obligations in the research context, and it allows us to consider whether there may be research obligations in the therapeutic context. This paper demonstrates the undecidability of a number of logics with quantification over public announcements: arbitrary public announcement logic, group announcement logic, and coalition announcement logic. In APAL we consider the informative consequences of any announcement, in GAL we consider the informative consequences of a group of agents all of which are simultaneously making known announcements. So this is more restrictive than APAL. Finally, CAL is as GAL except that we now quantify over anything the agents not in that group (...) may announce simultaneously as well. The logic CAL therefore has some features of game logic and of ATL. We show that when there are multiple agents in the language, the satisfiability problem is undecidable for APAL, GAL, and CAL.
